1. Authorization The CLIENT authorizes TECLEO to conduct an evaluation of the media or data to determine the nature of the damage and provide a quotation for the recovery there of, timing and estimated success rate. The evaluation is free and no work beyond this evaluation will be charged without explicit CLIENT approval. 2. Client Legal Rights The CLIENT acknowledges that he or she is the legal owner, representative, or otherwise has a legitimate right to the property or act on the owners behalf and all data contained therein sent to Tecleo data recovery. Any property left with Tecleo data recovery unclaimed for 90 days, will be disposed. 3. Liability TECLEO assumes no liability for any claims regarding the physical functioning of media and or equipment nor the condition or existence of data on storage media supplied before, during or after service. TECLEO is not liable for any direct or indirect damages, including loss of data, loss of revenue, incidental or consequential, before, during or after service and also assumes no liability for shipments. 4. Confidentiality The CLIENT agrees that TECLEO may use any information or data supplied with the storage media for the purpose of fulfilling the engagement. TECLEO agrees to maintain strict CLIENT confidentiality. All information, data and equipment handed over or recovered by TECLEO shall be deemed confidential and proprietary to our CLIENT's and shall not be disclosed to any third parties in any manner unless required to do so under South African law. Data media and recovered data are handled only by designated and authorized personnel appointed by the management of TECLEO. 5. Payment Payment is due in full upon completion of successful recovery, prior to release of data (whether shipped, picked up or downloaded). Other payment arrangements may be made prior to recovery. We accept cash, bank transfer & check. 6. Media Warranty: TECLEO gives warranty on all return media found to be Dead on Arrival (DOA) within 5 days of shipment. Any additional warranty claims must be presented to the original manufacturer. TECLEO will keep all recovered data for up to 7 days to insure against DOA instances. 7. Shipping: All shipping charges are the responsibility of the customer regardless if the data is recovered or not. 8. Data Recovery Guarantee: Your recovery comes with a data guarantee. If TECLEO, does not recover the data as promised, we will do everything possible to rectify the recovery ( including: re-shipment at our cost the original drive for additional recovery attempts, etc.) or refund all or part of the recovery fees paid.
